Obviously any president elected on the promise to defend the constitution and faithfully execute the laws would, upon taking office, immediately rescind all of the executive modifications made to Obamacare. No exemption for congress and it’s staff, no waivers for unions and other favored groups and no subsidies or employer mandate in states that haven’t created a state exchange. Taking such action however unpopular in some circles would demonstrate fidelity to the rule of law. It would also insure a speedy repeal of Obamacare. Many of the twenty something changes to the healthcare law were made via emails or press release without even an executives order.
Speaking of executive orders, what the hell! It appears that the legitimacy of executive orders or at least the extensive use of them is based on the fact that presidents have been issuing them like, for a really long time. Once again what the hell! Given their questionable parentage one could argue that executive orders could not be used by a principled constitutional president. I’d argue it is perfectly acceptable to use executive orders to rescind previous executive orders. Therefore any previous order rescinded by president Hardass would halt any and all regulations or other actions based on the rescinded order. The exceptions would be those orders that subsequently were modified or augmented by legislation. An example would JFK’s executive order allowing federal workers to unionize. Since that order congress has passed legislation dealing with federal employee unions thus making it unclear what rescinding JFK’s original executive order would do. Rescind it anyway see what happens. Rescind all of Obama’s executive orders moments after taking the oath of office. Then somewhat more judiciously start rescinding all the preceding presidents’ orders.
The Economy
Shermanizing and the dismantling the fourth branch regulatory state would largely free our economy. Drastically reducing the hours and money squandered complying would allowing businesses to concentrate on productive endeavors. Utilizing our ample energy reserves would also give a big boost to our economy as well as our national security. Lower energy prices along with changing the law to allow us to export unrefined oil and gas would diminish the power of our adversaries such as Russia and Iran. George W Bush expanded federal lands and waters available for energy exploitation. Unfortunately he waited until gas prices were skyrocketing and even worse he waited until near the end of his second term. This made it much easier for Obama to stop this expansion. Obviously approving the Keystone Pipeline would be an inauguration day executive order.
The second most important economic action would be tax reform. This would require congressional action and one primary reason it is an absolute imperative is that the tax code is arguably the most important tool of crony capitalism.
The only legitimate use of taxing power is to fund the necessary and proper functions of government. The temptation to use the tax code for social and economic engineering is apparently irresistible; small wonder given lobbyists economic power.
Without the massive and massively corrupt fourth branch and the equally corrupt tax regime the jackbooted thugs have little to enforce and the left would have little use for them. This admittedly incomplete list of relief measures would be merely the beginning and that is what this little story is about. I say story because alas that’s all it is. A fantasy or perhaps fairy tale. There is no “Ruthless Hardass” on our horizon about to run for president and if there were he or she wouldn’t get the nomination of any party let alone win the election. Nor are there any running for any other elected offices. In short there is no reasonable belief that the ballot box is the route to our national salvation.
So what is to be done, some sort of uprising, “let it burn” or “burn it (the system) to the ground”?
Something to ponder for the future perhaps.
